1. Scope

These terms govern your use of the FrankenFrame application ("the App") provided by Platon Aifert ("we", "us"). The App is distributed through the Apple App Store; Apple's Standard Licensed Application End User License Agreement (EULA) also applies and prevails in case of conflict on App Store matters.

2. Licence

We grant you a personal, non-exclusive, non-transferable licence to use the App on Apple devices that you own or control, in accordance with the App Store Terms and Apple's Media Services Terms. The App is licensed, not sold, to you.

3. Trial and purchase

The App offers a free trial period, after which full functionality requires a one-time purchase. There is no subscription. Billing, payment and refunds are handled exclusively by Apple through the App Store; please refer to Apple's policies for refund requests.

4. Updates

We may provide updates that fix defects or meet legal requirements. New features and major new versions are provided at our discretion and may be offered as separate products. We do not promise lifetime feature updates.

5. Acceptable use

You agree not to reverse engineer, decompile or disassemble the App except to the extent this restriction is prohibited by applicable law, and not to use the App unlawfully.

6. Disclaimer and liability

The App is provided "as is" to the extent permitted by law. Nothing in these terms limits your mandatory statutory rights as a consumer or our liability for intent, gross negligence, injury to life, body or health, or under applicable product-liability law.

7. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.

8. Apple

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple is not responsible for the App or its content.

1. Geltungsbereich

Diese Bedingungen regeln die Nutzung der Anwendung FrankenFrame ("die App"), bereitgestellt von Platon Aifert ("wir"). Die App wird über den Apple App Store vertrieben; ergänzend gilt Apples Standard-Lizenzvertrag für Programme (EULA), der bei App-Store-Fragen im Konfliktfall vorgeht.

2. Lizenz

Wir gewähren Ihnen eine persönliche, nicht ausschließliche, nicht übertragbare Lizenz zur Nutzung der App auf Apple-Geräten, die Sie besitzen oder kontrollieren, gemäß den App-Store-Bedingungen. Die App wird lizenziert, nicht verkauft.

3. Test und Kauf

Die App bietet einen kostenlosen Testzeitraum; danach erfordert der volle Funktionsumfang einen einmaligen Kauf. Es gibt kein Abonnement. Abrechnung, Zahlung und Erstattungen werden ausschließlich von Apple über den App Store abgewickelt; für Erstattungen gelten die Richtlinien von Apple.

4. Updates

Wir können Updates bereitstellen, die Mängel beheben oder gesetzliche Anforderungen erfüllen. Neue Funktionen und große neue Versionen erfolgen nach unserem Ermessen und können als eigenständige Produkte angeboten werden. Ein Anspruch auf dauerhafte Feature-Updates ("lifetime updates") besteht nicht.

5. Zulässige Nutzung

Sie verpflichten sich, die App nicht zurückzuentwickeln, zu dekompilieren oder zu disassemblieren, soweit dies nicht gesetzlich erlaubt ist, und die App nicht rechtswidrig zu nutzen.

6. Gewährleistung und Haftung

Die App wird im gesetzlich zulässigen Rahmen "wie besehen" bereitgestellt. Zwingende gesetzliche Verbraucherrechte sowie unsere Haftung für Vorsatz, grobe Fahrlässigkeit, Verletzung von Leben, Körper oder Gesundheit oder nach dem Produkthaftungsgesetz bleiben unberührt.

7. Anwendbares Recht

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Zwingende Verbraucherschutzvorschriften Ihres Wohnsitzlandes bleiben unberührt.

8. Apple

Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen und können sie durchsetzen. Apple ist nicht für die App oder deren Inhalte verantwortlich.
